1. Acceptance of Terms

Welcome to Sky Aura Pool, Dubai's premier infinity pool destination. By accessing our facilities, making a reservation, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy. These terms constitute a legally binding agreement between you and Sky Aura Pool.

If you do not agree with any part of these terms, you must not use our services or access our facilities. We reserve the right to refuse service to anyone for any reason at any time, in accordance with applicable laws and regulations.

2. Facility Access and Reservations

2.1 Booking Requirements

Access to Sky Aura Pool requires advance reservation through our official website, mobile application, or authorized booking partners. All reservations are subject to availability and confirmation. We recommend booking at least 48 hours in advance, especially during peak seasons and weekends.

2.2 Age Restrictions

Sky Aura Pool is an exclusive adult-oriented facility. The following age policies apply:

  • Guests must be 21 years of age or older to access the infinity pool area
  • Valid government-issued photo identification must be presented upon entry
  • Children under 21 are not permitted in the pool area, even when accompanied by adults
  • Special family sessions may be arranged upon request, subject to availability and additional terms

2.3 Reservation Modifications and Cancellations

We understand that plans may change. Our cancellation policy is designed to be fair while protecting our ability to serve all guests:

  • Free Cancellation: Cancel up to 24 hours before your scheduled visit for a full refund
  • Late Cancellation: Cancellations within 24 hours of your reservation will incur a 50% cancellation fee
  • No-Show: Failure to arrive without prior cancellation will result in forfeiture of the full booking amount
  • Modifications: Date and time changes are subject to availability and must be requested at least 12 hours in advance

2.4 Check-In Procedures

To ensure a smooth experience, please arrive 15 minutes before your scheduled time. Late arrivals may result in reduced access time without refund. Check-in requires presentation of your booking confirmation and valid identification.

3. Pricing and Payment Terms

3.1 Pricing Structure

All prices are displayed in UAE Dirhams (AED) and include applicable taxes unless otherwise stated. Our pricing varies based on:

  • Time of day (peak vs. off-peak hours)
  • Day of the week (weekday vs. weekend rates)
  • Season (high season vs. low season)
  • Package type (standard access, premium cabana, VIP experience)
  • Duration of visit

3.2 Payment Methods

We accept the following payment methods:

  • Major credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Digital wallets (Apple Pay, Google Pay, Samsung Pay)
  • Bank transfers for corporate bookings

Full payment is required at the time of booking to confirm your reservation. We use secure, encrypted payment processing to protect your financial information.

3.3 Promotional Offers and Discounts

Sky Aura Pool periodically offers promotional discounts, including first-visit discounts, seasonal offers, and loyalty rewards. Terms and conditions specific to each promotion will be clearly stated at the time of offer. Promotional codes cannot be combined unless explicitly stated, and all offers are subject to availability and blackout dates.

3.4 Refund Policy

Refunds are processed according to our cancellation policy outlined in Section 2.3. Approved refunds will be returned to the original payment method within 7-10 business days. Processing times may vary depending on your financial institution.

4. Facility Rules and Guest Conduct

4.1 Safety Regulations

Your safety is our highest priority. All guests must adhere to the following safety rules:

  • No running, diving, or horseplay in or around the pool area
  • Swimming ability is required; non-swimmers must wear appropriate flotation devices
  • Follow all posted safety signs and lifeguard instructions immediately
  • Report any unsafe conditions or injuries to staff immediately
  • Children (during family sessions) must be supervised by adults at all times
  • Glass containers are strictly prohibited in the pool area
  • Appropriate swimwear is mandatory; street clothes are not permitted in the pool

4.2 Health and Hygiene Requirements

To maintain the highest standards of cleanliness and guest comfort:

  • Shower before entering the pool
  • Guests with open wounds, bandages, or contagious conditions are not permitted to use the pool
  • Proper swimwear must be worn at all times
  • Food and beverages from outside sources are not permitted
  • Smoking is only allowed in designated areas

4.3 Behavioral Standards

Sky Aura Pool is a luxury destination designed for relaxation and enjoyment. We expect all guests to:

  • Respect other guests' privacy and personal space
  • Maintain appropriate noise levels
  • Refrain from offensive language or behavior
  • Follow staff instructions promptly and courteously
  • Respect our facilities and equipment

We reserve the right to remove any guest who violates these standards without refund. Severe violations may result in permanent ban from our facilities.

4.4 Photography and Videography

Personal photography for private use is permitted. However:

  • Commercial photography or videography requires prior written permission
  • Drone usage is strictly prohibited
  • Respect other guests' privacy; do not photograph others without consent
  • Professional equipment may be restricted during peak hours

Important Notice: Sky Aura Pool reserves the right to refuse entry or remove any guest who appears to be under the influence of alcohol or drugs, or whose behavior poses a risk to themselves or others.

5. Liability and Risk Acknowledgment

5.1 Assumption of Risk

By using Sky Aura Pool facilities, you acknowledge and accept that swimming and water activities involve inherent risks, including but not limited to:

  • Risk of drowning or near-drowning
  • Slip and fall injuries
  • Exposure to sun and heat
  • Interaction with other guests
  • Equipment malfunction

You voluntarily assume all risks associated with your use of our facilities and agree to take full responsibility for your own safety.

5.2 Limitation of Liability

To the fullest extent permitted by UAE law, Sky Aura Pool, its owners, operators, employees, and affiliates shall not be liable for:

  • Personal injury, death, or property damage arising from your use of our facilities
  • Loss or theft of personal belongings
  • Injuries resulting from failure to follow posted rules and staff instructions
  • Acts of nature, including extreme weather conditions
  • Actions of other guests

Our total liability for any claim shall not exceed the amount you paid for your reservation.

5.3 Personal Property

While we provide secure locker facilities, Sky Aura Pool is not responsible for lost, stolen, or damaged personal property. We strongly recommend:

  • Using provided lockers for valuables
  • Not bringing unnecessary valuables to the facility
  • Purchasing travel insurance for high-value items
  • Keeping personal belongings secured at all times

5.4 Medical Conditions

Guests with pre-existing medical conditions, including but not limited to heart conditions, respiratory issues, pregnancy, or recent surgeries, should consult their physician before using our facilities. You are responsible for informing our staff of any medical conditions that may affect your safe use of the pool.

6. Intellectual Property Rights

All content on the Sky Aura Pool website, mobile applications, and marketing materials, including but not limited to text, graphics, logos, images, videos, and software, is the property of Sky Aura Pool or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

6.1 Trademarks

The Sky Aura Pool name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sky Aura Pool. You may not use these marks without our prior written permission.

6.2 Restrictions on Use

You may not:

  • Reproduce, distribute, or create derivative works from our content
  • Use our content for commercial purposes without authorization
  • Remove copyright or proprietary notices from any content
  • Use automated systems to access or collect data from our platforms

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

  • Government actions or regulations
  • Pandemics or public health emergencies
  • Utility failures or infrastructure damage
  • Labor disputes or strikes

In such events, we will make reasonable efforts to notify affected guests and offer alternative arrangements or refunds as appropriate.

9. Modifications to Terms

Sky Aura Pool reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

We will make reasonable efforts to notify registered users of material changes via email or through prominent notices on our website. However, it is your responsibility to review these terms periodically.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to conflict of law principles.

10.2 Dispute Resolution

In the event of any dispute arising from these terms or your use of our services:

  • Informal Resolution: We encourage you to contact us first to seek an informal resolution
  • Mediation: If informal resolution fails, disputes may be submitted to mediation
  • Arbitration: Unresolved disputes shall be settled by binding arbitration in Dubai, UAE
  • Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of Dubai for any legal proceedings

10.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms applicable to specific services, constitute the entire agreement between you and Sky Aura Pool regarding your use of our facilities and services. These terms supersede all prior or contemporaneous communications, whether electronic, oral, or written.

13. Waiver

No waiver of any term or condition of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
